ⓘ You agree to these terms when you use our games or any of our services.

Welcome to SPARKS. This Terms of Service (Terms) governs your access and use of products, content and services offered by SPARKS, such as game software and related updates, upgrades and features, and all online and mobile services, platforms, websites, and live events hosted by or associated with SPARKS (collectively "SPARKS Services"). This Terms is between you and the SPARKS entity listed in Section 11(B) below.

ⓘ If you don’t agree, please don’t install or use our games or services.

BY USING SPARKS SERVICES, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SPARKS SERVICES.

1. SPARKS Account

ⓘ You need an SPARKS Account to play most SPARKS games. To create one, you must be at least the minimum age and your parents must read and agree to these terms if you are a minor. SPARKS can suspend or terminate your account if you break this Terms. You may cancel your SPARKS Account or any SPARKS subscriptions at any time.

You need an SPARKS Account to access and use many SPARKS Services, including to play online.

To create an SPARKS Account or bind an email address to your account, you must provide truthful, accurate, and complete information and keep it updated. Where SPARKS offers guest play or other limited-access modes, binding an email address is voluntary; however, certain account security, recovery, customer support, payment verification, cross-device, social, or other features may require or work better with a bound email address. The email address you provide must be valid, controlled by you or, where applicable, by your parent or legal guardian, and capable of receiving account-related notices. You are solely responsible for the authenticity, accuracy, continued accessibility, and lawful use of that email address.

You must meet the minimum digital age or other minimum age requirement applicable in your country or region to create and use an account on your own. If you are below that age or are otherwise a minor under applicable law, your parent or legal guardian must review and agree to this Terms, provide any consent required by applicable law or by SPARKS, and supervise your access to and use of SPARKS Services. By creating, using, or permitting use of an account for a minor, the parent or legal guardian represents and warrants that they are legally authorized to do so and agree to be responsible for the minor’s acts to the extent permitted by law. SPARKS recommends that parents and guardians familiarize themselves with parental controls on devices they provide to a child.

You are responsible for the activity on your SPARKS Account. You must keep your login credentials and any bound email secure, must not share the account except where a feature expressly permits lawful delegated access, and must promptly notify SPARKS if you know or reasonably suspect unauthorized access, credential compromise, loss of control over the bound email, or any other account security incident. Your SPARKS Account may be suspended or terminated if someone else uses it to engage in activity that violates this Terms. SPARKS may require identity, account-ownership, payment, or guardian verification before taking action on security-related requests.

You may cancel your SPARKS Account or a subscription to an SPARKS Service at any time by contacting SPARKS's Customer Service Department at playerservice@huntingsniper.games. To complete your request, SPARKS may collect fees or costs incurred, if allowed by law, and any amounts owed to third-party vendors or content providers.

If your SPARKS Account has not logged in to any SPARKS Service for a continuous period of twenty-four (24) months, or for any longer period required by applicable law, platform rules, or SPARKS’s then-current data retention requirements, SPARKS may designate the account as a dormant account. Where reasonably practicable, SPARKS may provide prior notice to you through the bound email address, in-service message, website notice, or other contact information associated with the account, and may request that you reactivate the account within the period specified in the notice. If you do not reactivate the account within that period, SPARKS may, to the extent permitted by applicable law, suspend, deactivate, delete, anonymize, or reclaim the dormant account and any associated game data, identifiers, nicknames, user-generated content, social records, progress records, virtual currency, virtual items, website payment center records, or other entitlements associated with that account. Notwithstanding the foregoing, SPARKS may retain, block from deletion, or separately archive any information, records, or transaction data that SPARKS is required or reasonably entitled to retain for legal, regulatory, tax, accounting, fraud prevention, security, dispute resolution, enforcement, audit, backup, or compliance purposes. For the avoidance of doubt, SPARKS is not obligated to maintain dormant accounts or any associated data, content, or entitlements beyond the period required by applicable law or SPARKS’s legitimate operational needs, and nothing in this paragraph limits any non-waivable rights you may have under applicable consumer protection or other mandatory laws.

A bound email address is used only for account security and service administration purposes, such as password reset, login verification, abnormal-login or account-security alerts, account recovery, payment-risk verification, and other necessary account-related notices. SPARKS will not use a bound email address to send marketing emails, and SPARKS does not sell your personal information or disclose your personal information to unrelated third parties for their own direct marketing purposes.

If you need to unbind or change a bound email address, you must contact Customer Support or operations support through the channels designated by SPARKS and complete any identity, account-ownership, security, payment, or guardian verification process we reasonably require. SPARKS may refuse, delay, or condition an unbinding or change request where necessary to prevent fraud, account theft, payment abuse, security risks, unresolved disputes, or legal non-compliance.


If you are a minor, any purchase, subscription, payment, top-up, redemption, or other transaction in SPARKS Services, including through an app store, third-party platform, or SPARKS’s official website payment center, must be made with the authorization of your parent or legal guardian to the extent required by applicable law. Where applicable law, a platform’s mandatory billing rules, or a parent or guardian’s valid legal withdrawal or cancellation right entitles a minor to a refund, the parent or legal guardian may contact us or the relevant billing provider and submit reasonable proof of identity, guardianship, transaction ownership, and the circumstances of the request.

SPARKS may investigate the request, coordinate with the relevant app store, platform, or payment processor, and, where the request is valid, provide a refund, partial refund, service credit, reversal, or other remedy as required or permitted by applicable law and binding billing rules. SPARKS may also suspend or restrict the affected account during the review, and may revoke unused or improperly obtained virtual currency, items, entitlements, or access associated with the refunded transaction to the extent permitted by law.

Except where a longer period, different remedy, or non-waivable right is required by applicable law or binding platform rules, refund requests should be submitted without undue delay and with sufficient supporting information. To the fullest extent permitted by law, SPARKS may decline requests that are fraudulent, abusive, repetitive, unsupported, or relate solely to virtual currency, items, randomized rewards, or services that have already been fully delivered, consumed, redeemed, or materially used. Nothing in this Section limits any non-waivable statutory rights of minors, parents, or consumers.

2. License

ⓘ SPARKS grants you access to our games and services to you for your personal enjoyment.

The SPARKS Services are licensed to you, not sold. SPARKS grants you a personal, limited, non-transferable (i.e., not for sharing), revocable and non-exclusive license to use the SPARKS Services to which you have access for your non-commercial use, subject to your compliance with this Terms. You may not access, copy, modify or distribute any SPARKS Service, Content or Entitlements (as those terms are defined below), unless expressly authorized by SPARKS or permitted by law. You may not reverse engineer or attempt to extract or otherwise use source code or other data from SPARKS Services, unless expressly authorized by SPARKS or permitted by law. SPARKS or its licensors own and reserve all other rights, including all right, title and interest in the SPARKS Services and associated intellectual property rights.

3. Content and Entitlements

ⓘ SPARKS provides games, features and content through a series of entitlements. Some entitlements are unlocked using virtual currency that has no value outside of our games.

The SPARKS Services include Content and Entitlements. Content is the software, technology, text, forum posts, chat posts, profiles, widgets, messages, links, emails, music, sound, graphics, pictures, video, code, and all audio visual or other material appearing on or coming from SPARKS Services, as well as the design and appearance of our websites. All Content is either owned by SPARKS or its licensors.

Entitlements are rights that SPARKS licenses to you to access or use the online or off-line elements of SPARKS Services. Examples of Entitlements include access to digital or unlockable Content; additional or enhanced functionality (including multiplayer services); subscriptions; virtual assets; unlock keys or codes, serial codes or online authentication; in-game accomplishments; and virtual points, coins, or currencies.

We refer to these virtual points, coins or currencies as "SPARKS Virtual Currency". SPARKS Virtual Currency and other Entitlements may be obtained only from SPARKS, the relevant app store or platform, SPARKS’s official website payment center, or other channels expressly authorized by SPARKS. When you obtain SPARKS Virtual Currency from us or our authorized partners, you receive a personal, limited, non-assignable, non-exclusive, revocable license to access and select the Entitlements that SPARKS expressly makes available to you.

SPARKS Virtual Currency has no monetary value and has no value outside of our products and services. Except as expressly authorized by SPARKS or required by applicable law, SPARKS Virtual Currency cannot be sold, traded, transferred, or exchanged for cash; it only may be redeemed for Entitlements available for the SPARKS Service. Purchases and redemptions made through SPARKS’s official website payment center or any authorized payment channel are final once the relevant digital content or service is made available, except where refunds, withdrawal rights, or other remedies are required by applicable law, binding platform rules, or an express written refund policy. SPARKS Virtual Currency is otherwise non-refundable, and you are not entitled to a refund for any unused SPARKS Virtual Currency. Once you redeem SPARKS Virtual Currency for an Entitlement, that Entitlement is not returnable, exchangeable, or refundable, except as required by law.

You represent and warrant that you are authorized to use the selected payment method and that all payment information you submit in connection with any purchase, including through SPARKS’s official website payment center, is true, current, and complete. SPARKS may refuse, suspend, or cancel a transaction where fraud, misuse, pricing error, sanctions risk, export-control risk, or other legal non-compliance is suspected.

You will provide at your own expense the equipment, Internet connection and charges required to access and use SPARKS Services.

 

4. Availability of SPARKS Services and Updates

ⓘ Our games and services may not always be available or operate on all devices. We also may make updates or changes to our games and services, which might impact your use or game progress.

We do not guarantee that any SPARKS Service, Content or Entitlement will be available at all times, in all locations, or at any given time or that we will continue to offer a particular SPARKS Service, Content or Entitlements for any particular length of time. SPARKS does not guarantee that SPARKS Services can be accessed on all devices, by means of a specific Internet or connection provider, or in all geographic locations.

From time to time, SPARKS may update or modify an SPARKS Service, Content or Entitlements, and/or you may lose access to certain Content or Entitlements without notice if, at our discretion, we must remove such Content or Entitlements from the SPARKS Services for legal, contractual, licensing, security, safety, anti-abuse, technical, operational, or business reasons, or if the Content or Entitlements could harm SPARKS, users, or third parties. Where reasonably practicable and where required by applicable law, SPARKS will provide notice of material adverse changes in advance. Updates and modifications may be required in order to continue to use SPARKS Services.

SPARKS may need to update, or reset certain parameters to balance game play and usage of SPARKS Services. These updates or "resets" may cause you setbacks within the relevant game world and may affect characters, games, groups or other Entitlements under your control.

SPARKS may also take actions on your SPARKS Account and Entitlements without notice to you to protect you or SPARKS, such as preventing unauthorized access, resetting SPARKS Account passwords, suspending SPARKS Account access, deleting data or removing SPARKS Accounts from SPARKS Services. Your availability to SPARKS Services may also be affected in response to actual or suspected Rules of Conduct violations, as further described in Section 5.

5. Rules of Conduct

ⓘ We want you to have a good time playing our games. So we expect you, like all players, to respect SPARKS, our employees and representatives as well as your fellow players. This means, for example, obey the law, don’t cheat, don’t be offensive, don’t hack our software, don’t spam or bot, don’t lie to SPARKS or our players. Those are the highlights. Read the full list of what not to do in the Rules of Conduct.

When you access or use a SPARKS Service, you agree that you will not:

· Violate any law, rule or regulation.

· Interfere with or disrupt any SPARKS Service or any server or network used to support or provide an SPARKS Service, including any hacking or cracking into an SPARKS Service.

· Use any software or program that damages, interferes with or disrupts an SPARKS Service or another's computer or property, such as denial of service attacks, spamming, hacking, or uploading computer viruses, worms, Trojan horses, cancelbots, spyware, corrupted files and time bombs.

· Interfere with or disrupt another player's use of an SPARKS Service. This includes disrupting the normal flow of game play, chat or dialogue within an SPARKS Service by, for example, using vulgar or harassing language, being abusive, excessive shouting (all caps), spamming, flooding or hitting the return key repeatedly.

· Harass, threaten, bully, embarrass, spam or do anything else to another player or any SPARKS employee or representative that is unwanted, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, heritage, etc. Hate speech is not tolerated. We won't tolerate any unwanted conduct against any SPARKS employee and representative because of their affiliation with SPARKS in SPARKS Services or anywhere else.

· Contribute UGC or organize or participate in any activity, group or guild that is inappropriate, abusive, harassing, profane, threatening, hateful, offensive, vulgar, obscene, sexually explicit, defamatory, infringing, invades another's privacy, or is otherwise reasonably objectionable.

· Publish, post, upload or distribute UGC or content that is illegal or that you don't have permission to freely distribute.

· Publish, post, upload or distribute any content, such as a topic, name, screen name, avatar, persona, or other material or information, that SPARKS (acting reasonably and objectively) determines is inappropriate, abusive, hateful, harassing, profane, defamatory, threatening, obscene, sexually explicit, infringing, privacy-invasive, vulgar, offensive, indecent or unlawful.

· Post a message for any purpose other than personal communication. Prohibited messages include advertising, spam, chain letters, pyramid schemes and other types of solicitation or commercial activities.

· Impersonate another person or falsely imply that you are an SPARKS employee or representative.

· Improperly use in-game support or complaint buttons or make false reports to SPARKS staff.

· Attempt to obtain, or phish for, a password, account information, or other private information from anyone else on SPARKS Services.

· Make use of any payment methods or refund systems to access, purchase or refund SPARKS Services for fraudulent purposes, or without permission of the authorized owner, or otherwise concerning a criminal offence or other unlawful activity.

· Use any robot, spider or other automated device or process to access SPARKS Services for any purpose such as scraping data, abuse SPARKS Services, account creation, or copying material.

· Modify any file or any other part of the SPARKS Service that SPARKS does not specifically authorize you to modify.

· Use or distribute unauthorized software programs or tools (such as "auto", "macro", hack or cheat software), or use exploits, bugs or problems in an SPARKS Service to gain unfair advantage.

· Engage or assist in cheating or other anticompetitive behavior (such as boosting, collusion, and match or matchmaking manipulation).

· Use or distribute counterfeit software or SPARKS Content, including SPARKS Virtual Currency.

· Attempt to use an SPARKS Service on or through any service that is not controlled or authorized by SPARKS, or otherwise intentionally obfuscate your network connection or location or other metadata to gain access to an SPARKS Service, make purchases, or otherwise access an SPARKS Service.

· Sell, buy, share, trade or otherwise transfer or offer to transfer your SPARKS Account, any personal access to SPARKS Services, or any SPARKS Content associated with your SPARKS Account, including SPARKS Virtual Currency and other Entitlements, either within an SPARKS Service or on a third-party website, or in connection with any out-of-game transaction, unless expressly authorized by SPARKS.

· Use an SPARKS Service in a country in which SPARKS is prohibited from offering such services under applicable export control laws.

· If an SPARKS Service requires you to create a "username" or a "persona" to represent yourself in-game and online, you should not use your real name and may not use a username or persona that is used by someone else or that SPARKS determines is vulgar or offensive or violates someone else's rights.

· Engage in any other activity that significantly disturbs the peaceful, fair and respectful gaming environment of an SPARKS Service.

· Use information about users publicly available in any SPARKS Service (e.g. on a leaderboard) for any purpose unrelated to the Service, including to attempt to identify such users in the real world.

· Promote, encourage or take part in any prohibited activity described above.

To enforce these rules, SPARKS may monitor your activity, investigate suspected misconduct, restrict functionality, and remove, block, edit, or disable access to any user-generated Content ("UGC"). If you do not follow these rules, SPARKS may remove your UGC, warn you, suspend you, ban you permanently, limit or disable specific features (including chat, voice, social, UGC, payment, or competitive features), or place other restrictions on your SPARKS Account, games, devices, payment instruments, regions, or related services.

If you or someone using your SPARKS Account breaks these rules (or any additional rules posted by specific SPARKS Services that apply to your conduct on those services), SPARKS may send you a warning or otherwise issue a sanction, including revoking access to certain or all SPARKS Services, Content or Entitlements, or terminating your SPARKS Account as described in Section 7. When practical, SPARKS will notify you of the action it takes in response to rule-breaking or breach of this Terms.

If you encounter another user who is violating any of these rules, please report this activity to SPARKS using the "Help" or "Report Abuse" functions in the relevant SPARKS Service, if available, or contact Customer Support at playerservice@huntingsniper.games.

SPARKS may monitor, record, review, retain, moderate, and disclose your voice or text communications (together, “communications”) and other UGC as reasonably necessary to operate, secure, moderate, support, investigate, and enforce the SPARKS Services, this Terms, applicable law, and our community standards. If we detect inappropriate UGC or communications, we may sanction the player who submitted it and, if applicable, remove it from any SPARKS Service at our discretion. Remember that your communications, including your UGC in an SPARKS Service, may be seen and heard by others, including players and SPARKS.

To the extent permitted by applicable law, you grant SPARKS a worldwide, non-exclusive, sublicensable, transferable, royalty-free license to host, store, reproduce, modify as technically necessary, adapt, translate, publish, publicly display, publicly perform, distribute, communicate, and otherwise use any UGC you submit through SPARKS Services for the purposes of operating, providing, securing, improving, supporting, promoting, moderating, and making available SPARKS Services. You represent and warrant that you have all rights necessary to submit such UGC and to grant the foregoing license. To the extent permitted by law, you waive, or agree not to assert against SPARKS and its designees, any moral rights or similar rights in such UGC to the extent necessary for the permitted uses described in this Terms.

In countries, territories, or other jurisdictions where consent or specific notice is required for monitoring or recording of communications, SPARKS will provide such notice or obtain such consent in the manner required by applicable law. If you are a minor, your parent or legal guardian is responsible for providing or authorizing any consent required by law to the extent such consent may lawfully be given in that manner.

Your use of SPARKS Services is subject to SPARKS's Privacy Policy at https://www.huntingsniper.games/privacy, which is incorporated by reference into this Terms.

6. Games

ⓘ This section applies to our games, in particular mobile games.

This Section applies to SPARKS's games and game subscriptions ("SPARKS Games"), including SPARKS Games that run on a mobile phone ("SPARKS Mobile Games"), and the SPARKS-owned client application and related services that distributes SPARKS PC Games

A. Technical and Content Protection Measures

ⓘ We use specific security software to combat piracy and cheating, and tampering with it can result in losing access to our games.

SPARKS utilizes technical or content protection measures, developed by SPARKS or third-party partners, for SPARKS Services in order to prevent piracy and the unauthorized copying or use of SPARKS Games. Attempting to circumvent, disable or tamper with these measures shall terminate this license.

C. Monitoring and Anti-Cheat Measures

ⓘ SPARKS installs software to detect cheating or hacking. These programs send data on your computer to SPARKS.

SPARKS utilizes technologies to detect and prevent cheating in the use of SPARKS Services, and in particular, SPARKS Games. These technologies may be developed by SPARKS or a third party.

Where reasonably necessary to detect or prevent cheating, fraud, automation, abuse, or security incidents, and subject to applicable law and any additional product notice required for a specific tool, these technologies may monitor and collect information from your gameplay environment and device that is relevant to the integrity and security of SPARKS Services, including memory, running processes, device identifiers, game files, file metadata, communications related to game sessions, and other technical data reasonably necessary to investigate suspected violations of Section 5. SPARKS does not use such technologies for unrelated marketing purposes.

Some anti-cheat or integrity tools may require elevated operating-system permissions or may not function on every device. If a particular game or anti-cheat tool requires additional permissions, disclosures, or notices under applicable law, SPARKS will provide them in the relevant product flow or notice.

SPARKS may collect relevant information needed for our investigation and enforcement purposes, such as your account information, details related to an Unauthorized Third-Party Program, any SPARKS PC Game files that were modified, and the times cheating was detected. The collection and use of such data will be handled in accordance with this Terms and the Privacy Policy. We also may terminate your License and your SPARKS Account if we determine you have been cheating.

When you exit an online-capable game, these anti-cheat technologies will be deactivated.

7. Termination and Other Sanctions

If you break this Terms, applicable law, platform rules, payment rules, or service-specific rules, or if your account presents fraud, security, chargeback, abuse, or legal risk, SPARKS may suspend, restrict, or terminate your use of our games and services, subject to any statutory refund rights, binding platform billing rules, and any non-waivable rights you may have.

If we decide to shut down a game or a service, we will tell you at least 30 days in advance.

This Terms is effective until terminated by you or SPARKS. SPARKS may suspend, restrict, or terminate your access to any SPARKS Services or your SPARKS Account, temporarily or permanently, if SPARKS reasonably determines or suspects that you have violated this Terms, applicable law, platform rules, payment rules, or service-specific rules; that your account presents fraud, security, chargeback, abuse, or legal risk; or that suspension or termination is otherwise reasonably necessary to protect SPARKS, other users, third parties, or the integrity of the Services. Where reasonably practicable and not prohibited by law or investigative needs, SPARKS will notify you of the action and the general reason for it. If you have more than one SPARKS Account, depending on the type of violation or misuse, SPARKS may terminate or restrict all of your SPARKS Accounts and all related Entitlements. If your SPARKS Account is terminated, you will not have access to your SPARKS Account or Entitlements and may be barred from accessing or using any SPARKS Service again. Upon termination, your license under this Terms also shall terminate.

Instead of terminating your SPARKS Account, SPARKS may alternatively issue you a warning, suspend or alter your access to a particular SPARKS Service or your SPARKS Account, remove or revoke Entitlements at an SPARKS Account or device level, remove or delete any Content that is in violation of this Terms, ban your device or machine from accessing specific SPARKS Services, or limit chats, social features, UGC, purchases, rankings, tournament eligibility, or access from certain devices, regions, payment instruments, or IP ranges. If SPARKS takes any action described in this Section, you will not be entitled to a refund except to the extent required by applicable law, binding platform billing rules, or an express written refund policy, and no Entitlements will be credited to you or converted to cash or other forms of reimbursement except as required by law. Actions are cumulative and repeated rule-breaking may result in your SPARKS Account being terminated.

SPARKS may terminate any SPARKS Service, including any official website payment center function or online feature, at any time by giving at least thirty days' notice where reasonably practicable, either via email (if available), within the affected SPARKS Service, on the relevant website, or by other reasonable means. After online service termination, no software updates may be applied to our games, and we cannot guarantee our games will continue to function on newer or updated operating systems or remain available for download via application distribution services such as the iOS App Store and the Google Play Store. Any games or services available via such application distribution services after online service termination may be removed without further notice to you.

If you believe that any action has been taken against your Account, device, transaction, or Entitlements in error, you may contact Customer Support at playerservice@huntingsniper.games and submit an appeal or support request. SPARKS may require reasonable identity, account-ownership, payment, or guardian verification materials and may decline repetitive, abusive, or unsupported appeals. Any review will be conducted in SPARKS’s reasonable discretion, without prejudice to any non-waivable legal rights you may have.

If you terminate this Terms, you agree to cease all use of SPARKS Services.

Sections 7-8, 9-12 of this Terms survive termination of this Terms

8. Use of Data

SPARKS collects and processes information when you use our games, websites, payment center, and related services in order to operate, secure, support, maintain, improve, and provide the SPARKS Services, to verify accounts and payments, to prevent fraud and abuse, to comply with law, and as otherwise described in SPARKS’s Privacy Policy at https://www.huntingsniper.games/privacy. We encourage you to read the Privacy Policy carefully.

When you use an SPARKS Service, SPARKS may collect and store data from your computer or device, including information about your device, hardware, installed software, and operating system (such as IP address and device ID), information about your SPARKS Service usage, gameplay and usage statistics, system interactions, payment-risk signals, customer-support interactions, and peripheral hardware. If you play an SPARKS Service offline, certain data may be stored on your device and transmitted to SPARKS when your device connects to the Internet. SPARKS uses this information to provide and administer the Services, secure accounts, verify and process transactions, investigate misconduct, provide customer support, deliver account-related and service-related notices, conduct analytics, troubleshoot bugs, and otherwise improve your experience, in each case as described in the Privacy Policy. A bound email address is used for account security and service administration purposes, such as password reset, login verification, abnormal-login or account-security alerts, account recovery, payment-risk verification, and other necessary account-related notices. SPARKS will not use a bound email address to send marketing emails. SPARKS does not sell your personal information and does not disclose your personal information to unrelated third parties for their own direct marketing purposes.

Your personal information may be processed by SPARKS, its affiliates, and service providers in the countries where they operate, including outside your country of residence, subject to appropriate safeguards where required by applicable law. Additional details regarding data processing, international transfers, and your available rights are set out in the Privacy Policy.

You can manage certain data collection preferences in the Settings tab of the SPARKS Mobile Game client or through other controls made available by SPARKS. Certain processing is strictly necessary to provide, secure, support, or legally operate the Services and therefore cannot be disabled.

9. Third Parties

ⓘ You are responsible for your use of game servers and services not owned by SPARKS.

Some SPARKS Services may give you the option of playing on servers not owned or controlled by SPARKS or of accessing the Services through third-party platforms, accounts, or login providers. SPARKS does not control those services and is not responsible for your use of the SPARKS Service on or through them. These third-party services may subject you to additional or different terms, billing rules, privacy notices, age requirements, and restrictions.

SPARKS Services may include hyperlinks to third-party websites or may use third-party payment processors in connection with app-store billing, platform billing, or SPARKS’s official website payment center. Those third parties may collect data or solicit personal information from you. Except to the extent required by applicable law or expressly stated by SPARKS, SPARKS does not control those third parties and is not responsible for their content, availability, security, payment processing, collection, use, or disclosure of personal information, or for decisions made by them outside SPARKS’s reasonable control.

If you make a purchase through an app store, platform billing system, payment processor, or SPARKS’s official website payment center, your transaction may also be subject to that provider’s terms, billing rules, dispute procedures, refund rules, fraud controls, and privacy notice. You are responsible for complying with those third-party terms to the extent they apply to your transaction or use of the relevant service.

10. Warranties; Limitation of Liability

ⓘ SPARKS does not make any promises about our software, but the local law in your country may include certain warranties. The damages you can recover for legal claims are limited.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR ANY NON-EXCLUDABLE RIGHTS OR WARRANTIES THAT APPLY TO YOU UNDER THE LAWS OF YOUR COUNTRY OR REGION, SPARKS SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." IF YOU LIVE IN THE EEA, UNITED KINGDOM, JAPAN, KOREA, OR ANY OTHER JURISDICTION THAT PROVIDES NON-WAIVABLE CONSUMER GUARANTEES OR STATUTORY WARRANTIES, NOTHING IN THIS TERMS EXCLUDES OR LIMITS THOSE RIGHTS, AND SPARKS WILL PROVIDE THE SERVICES WITH THE LEVEL OF CARE, CONFORMITY, AND REMEDIES REQUIRED BY APPLICABLE LAW. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, SPARKS GIVES NO OTHER EXPRESS, IMPLIED, OR STATUTORY WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT OF THIRD-PARTY RIGHTS, AND WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE, OR PRACTICE. SPARKS DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE PRODUCT OR SPARKS SERVICE; THAT THE SPARKS SERVICE WILL MEET YOUR REQUIREMENTS; THAT OPERATION OF THE SPARKS SERVICE WILL BE UNINTERRUPTED OR FREE FROM ERRORS, BUGS, CORRUPTION, LOSS, INTERFERENCE, HACKING, OR VIRUSES; OR THAT SPARKS SERVICES WILL INTEROPERATE OR BE COMPATIBLE WITH ANY OTHER SOFTWARE. SPARKS DOES NOT WARRANT OR GUARANTEE ANY THIRD-PARTY PRODUCT OR SERVICE OFFERED VIA THE SPARKS APP STORE, THIRD-PARTY PLATFORM, OR PAYMENT CHANNEL.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPARKS AND ITS EMPLOYEES, LICENSORS, AFFILIATES, CONTRACTORS, AND BUSINESS PARTNERS WILL NOT BE LIABLE TO YOU FOR ANY LOSSES THAT WERE NOT CAUSED BY SPARKS’S BREACH OF THIS TERMS, OR FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE GOODS OR SERVICES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF SPARKS ARISING OUT OF OR RELATING TO THIS TERMS OR THE SPARKS SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID TO SPARKS FOR THE APPLICABLE SPARKS SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100. NOTHING IN THIS TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILFUL MISCONDUCT, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OR ALL OF THE ABOVE MAY NOT APPLY TO YOU.

11. General Terms

A. Entire Terms

ⓘ This Terms, together with other applicable SPARKS terms, forms the entire agreement; SPARKS may update it in accordance with Section 12.

This Terms, together with any other SPARKS terms that govern your use of SPARKS Services, constitutes the entire agreement between you and SPARKS regarding the SPARKS Services. Except as expressly provided in Section 12, this Terms may be amended or modified only by SPARKS in writing or by an authorized electronic update. SPARKS may assign or transfer this Terms, in whole or in part, to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign or transfer this Terms, any SPARKS Account, or any Entitlements except as expressly permitted by SPARKS or required by law. The failure of SPARKS to exercise any right under this Terms shall not constitute a waiver of that right or any other right. If any part of this Terms is held to be unenforceable, all other parts of this Terms shall continue in full force and effect.

B. Contracting Entity, Notices, Governing Law and Dispute Resolution

This Terms, and any dispute, controversy, difference, or claim arising out of or in connection with this Terms, the SPARKS Services, or any non-contractual obligations related to them, shall be governed by the laws of Singapore, excluding its conflict of laws rules. Any such dispute shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the SIAC Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Singapore. The tribunal shall consist of one (1) arbitrator, unless the SIAC Rules require otherwise. The language of the arbitration shall be English. Notwithstanding the foregoing, either party may seek interim or conservatory relief from any court of competent jurisdiction, and nothing in this Terms deprives you of any non-waivable right to bring a claim before a consumer authority, supervisory authority, small-claims forum, or court that applicable law expressly preserves for consumers.

C. Language

If SPARKS provides a translation of this Terms, the English-language version will control to the extent permitted by applicable law in the event of any inconsistency.

D. Force Majeure

SPARKS will not be liable for any delay or failure to perform caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, internet or utility outages, cyberattacks, epidemics, governmental acts, platform actions, sanctions restrictions, export-control restrictions, or failures of third-party service providers, except to the extent such liability cannot be excluded under applicable law.

12. Changes to this Terms

ⓘ This Terms can be updated by SPARKS at any time. If you do not agree to certain meaningful changes, you may not be able to play our games.

SPARKS may modify this Terms from time to time for legal, regulatory, security, safety, anti-abuse, technical, operational, commercial, or other reasonable business reasons, so please review it frequently. For users who accepted a previous version of this Terms, the revisions will become effective on the date stated in the notice or, if no date is stated, thirty (30) days after posting for material changes, unless a shorter period is required for legal, security, or anti-abuse reasons. Where required by applicable law or platform rules, SPARKS will seek your express acceptance before material changes take effect. Your continued use of SPARKS Services after the effective date means you accept the changes, unless applicable law requires a different method of acceptance. If you do not agree to the revised Terms, you must stop using the affected SPARKS Services. Changes will not apply retroactively where retroactive application is prohibited by applicable law.
